Welcome to Noereli. This Privacy Policy explains how we handle your data across the Noereli mobile application and our website.
Our privacy approach is based on transparency, user control and data minimization. We do not sell your data, we do not run ads and we use encryption to help protect your journal content, particularly when it is stored on your device or in encrypted backups.By using Noereli, you agree to the collection and use of information in accordance with this Privacy Policy. Noereli is currently intended only for users located in the United States, Canada, Australia and New Zealand.


1. Local-First Architecture and Encryption
Noereli is built on a local-first architecture designed to keep your most sensitive data under your control.Your Device: By default, your journal entries, AI insights and app data are stored securely and locally on your physical device.End-to-End Encrypted Cloud Sync: If you enable Cloud Sync, your journal entries and locally generated Contextual Memory are encrypted on your device before being sent to our servers. This data is locked with a key that only you possess. Gammahammer LLC uses encryption so that we cannot access your encrypted journal entries stored in our systems.User Control: Contextual Memory is generated locally and can be deleted at any time by removing your local data or disabling Cloud Sync.Data Export: If you choose to export your journal data, the exported file is not encrypted by Noereli and will be stored according to your device’s file system and settings. This means that anyone with access to your device or exported files may be able to read this data. You are responsible for securing exported files.Voice Journaling: Speech is transcribed locally using your operating system’s native tools. We do not collect or store raw audio files.


2. How We Use Artificial Intelligence
To provide reflective insights, Noereli uses third-party AI providers, such as Google Gemini via the Firebase SDK.

Processing vs. Storage: When you request AI features, selected journal content is securely transmitted to our AI providers for processing. Unlike your end-to-end encrypted cloud backups, data transmitted for AI inference must be decrypted temporarily so it can be processed by the AI model. Only the content you choose to analyze is transmitted for AI processing.

Data Usage and Training: We configure our integrations to request that data sent to AI providers is not used to train the providers’ models or Gammahammer LLC’s models. We rely on provider commitments regarding these data handling practices.

Service Provider Responsibility: We rely on our providers’ contractual safeguards and publicly stated security commitments to support data handling consistent with industry standards. Depending on the provider and configuration, limited temporary processing or logging may occur by the provider solely for safety, abuse monitoring and legally required compliance.

Automated Processing Configuration: We configure our integrations to request that your data be processed only through automated systems.

No Automated Decision-Making: AI insights are for reflection only and are not used for automated decision-making that produces legal, medical or similarly significant effects.


3. Security, Device Responsibility and Breaches
We use strong technical safeguards, including AES-GCM 256-bit encryption where applicable. However, no method of transmission or storage is 100% secure.Your Responsibility: You are responsible for maintaining device security and keeping your Noereli Recovery Key in a safe, offline location. If you lose your Recovery Key, your encrypted cloud backups remain permanently unrecoverable by us.

Data Breach Notification: In the event that account metadata, such as email addresses, is compromised, we will notify affected users via email within a legally compliant timeframe.


4. Information We Collect
We collect limited data only as necessary to provide and operate the Service.

Account and Payment Information: We collect your email address for account creation. Subscriptions are processed through RevenueCat and your native app store. We do not store credit card information.

Application Data and Usage Metrics: Each user account includes an internal profile called AppUser, which is necessary for core app functionality. It may also include a related object called AppUsage, which contains aggregated behavioral metrics such as feature interactions and interface preferences. This data is used for product functionality, improvement and user experience optimization. It does not include journal content, mood data or AI-generated insights.

Device Permissions: We request native permissions for Microphone, Notifications and Camera/Gallery access only as required for app features. We do not collect or process biometric data.

Usage Telemetry: We use Firebase Analytics and Crashlytics to collect aggregated usage patterns and crash reports. These signals are not used for advertising or persistent behavioral profiling. You can opt out of analytics in the Settings menu.


5. Medical Disclaimer and HIPAA Status
Gammahammer LLC provides a self-help tool, not a medical or clinical service. We are not a covered entity or business associate under HIPAA, and the information you provide is not considered Protected Health Information under US law.


6. Law Enforcement
Because of our end-to-end encrypted architecture, Gammahammer LLC does not possess the keys to decrypt your stored journal entries or Contextual Memory. In the event of a legally binding subpoena, we can only provide encrypted data blobs that we cannot decrypt, along with basic account metadata.As described in Section 2, if you choose to use AI features, those temporary processing flows are subject to the policies of our third-party AI providers.


7. Data Retention and Business Transfers
Data Retention: We retain encrypted cloud backups only while your account is active. Account data, including AppUser and AppUsage data, is retained while your account is active and deleted or anonymized within a reasonable period after account deletion. We do not retain AI processing data ourselves beyond what is necessary to provide the Service and rely on provider policies for any processing performed by them.

Account Deletion: You can initiate complete account deletion at any time directly within the Noereli app settings. Doing so will permanently remove your AppUser profile, delete your encrypted cloud backups and remove associated metadata from our servers.

Business Transfers: If Gammahammer LLC is involved in a merger, acquisition or asset sale, your information may be transferred as a business asset. We will provide notice before your information becomes subject to a different privacy policy.


8. Age Requirements
Noereli is intended only for users 18 years of age or older. If we discover that a user is under 18, we will take steps to delete their account and associated data in compliance with applicable law.


9. Third-Party Services, Account Data, Usage Metrics and Communications
To operate Noereli, we rely on trusted third-party service providers and collect limited additional information as described below.

Cloud Infrastructure: We use Google Firebase, including Firestore, to store encrypted user data and limited account and application data. Journal content is encrypted on your device before transmission and cannot be decrypted by Gammahammer LLC. In addition to encrypted content, we store certain application data required for the Service to function, including account information such as email address and account identifiers, as well as application state data associated with your profile, called AppUser. This information may be stored in an unencrypted or service-managed format where necessary to support core functionality.

Application Data and Usage Metrics: Each user account includes an internal application profile called AppUser, which stores core data required for the app to function and personalize your experience. Processing of AppUser data is necessary to provide the core functionality of the Service. AppUser may include a related data object called AppUsage, which contains aggregated behavioral metrics such as feature interactions, button taps, interface preferences, theme changes and general usage patterns.This data does not include journal content, mood data or AI-generated insights.This data is used for product functionality, improvement and user experience optimization.AppUsage data may be stored in a non-encrypted format.We implement reasonable administrative, technical and organizational safeguards to protect this data.If you opt out of analytics, collection and updating of AppUsage data will be disabled. Core AppUser data will continue to be processed because it is necessary to provide the Service.

Authentication Providers: If you create an account using third-party login providers, such as Apple or Google, we receive limited account information such as your email address and a unique user identifier. Authentication is handled by these providers in accordance with their respective privacy policies. We do not receive or store your third-party account passwords.

Product Feedback and Support Tools: We use Featurebase to manage feature requests and support submissions. If you choose to submit a request, you may provide your email address and message content, which is processed and stored by Featurebase on our behalf.

Website Contact Forms, Email Signups and Communications: If you contact us through our website or sign up for updates, we collect your email address and any information you choose to provide. We use MailerLite to manage email signups, subscriber lists and email communications. MailerLite may process information such as your email address, signup source, consent status and related technical information, including IP address, location, date and time where required for consent records. We use this information solely to respond to your inquiry, provide support or send product updates where you have opted in. You may unsubscribe from non-essential communications at any time by using the unsubscribe link in our emails.

Website Analytics: We use Umami to understand how visitors interact with our website, such as which pages are visited and how the site is used. Umami is a privacy-focused analytics tool and does not use cookies in its tracking code. We use this data to improve the website and understand general visitor behavior. We do not use Umami for advertising or cross-site tracking.

Website Hosting and Cookies: The Noereli website is hosted by Carrd. Carrd and related service providers may use cookies or similar technologies that are necessary for site functionality, performance and security. If we use MailerLite pop-up forms, embedded surveys or similar features, MailerLite may use cookies or local storage to manage form behavior and submissions. We do not use third-party advertising trackers.How We Use Contact Information: We may use your email address to respond to support inquiries, provide important service-related communications and send product updates or announcements where you have opted in. You may opt out of non-essential communications at any time.Data Sharing and Service Providers: We do not sell your personal data. We share limited information with third-party service providers strictly as necessary to operate the Service, including cloud infrastructure providers, authentication providers, analytics providers and customer support tools. These providers process data on our behalf and are expected to protect it and use it only for providing services to us.International Data Transfers: Your information may be processed and stored in countries other than your own, which may have different data protection laws than your jurisdiction, including the United States, where our service providers operate. By using the Service, you acknowledge that your data may be transferred to and processed in these jurisdictions.


10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of changes by posting the new Privacy Policy on this page and updating the Last Updated date at the top. You are advised to review this Privacy Policy periodically for any changes.

Welcome to Noereli. Please read these Terms and Conditions ("Terms") carefully before using the Noereli mobile application (the "Service"). By downloading, accessing or using Noereli, you agree to be bound by these Terms and our Privacy Policy.


1. Eligibility and Export Control
You must be at least 18 years old to use Noereli. If Gammahammer LLC determines that you are under 18, your account and data may be terminated without notice. You may not use, export or re-export Noereli except as authorized by United States law.


2. Medical Disclaimer and Mental Health Liability
NOERELI IS A SELF-GUIDED WELLNESS TOOL. IT IS NOT A MEDICAL DEVICE, A REPLACEMENT FOR PROFESSIONAL THERAPY OR A CRISIS INTERVENTION SERVICE.

Crisis Exclusion: If you are experiencing a mental health emergency or thoughts of self-harm, do not rely on Noereli. Call your local emergency services or a crisis hotline immediately.

AI Limitations: You acknowledge that the Service uses generative AI, which predicts text based on patterns. It does not possess knowledge, consciousness or professional judgment. You assume all risk of relying on AI outputs, including outputs generated by third-party AI providers.

Duty of Care: To the maximum extent permitted by law, you agree that Gammahammer LLC bears no fiduciary or clinical duty to you and is not liable for personal injury or emotional distress resulting from your use of the Service.


3. Account States and Data Sovereignty
Noereli is built on a local-first architecture. You are primarily responsible for managing and securing your data on your device and for safeguarding your access credentials.Contextual Memory: Derived insights generated on your device are stored locally or, if Cloud Sync is enabled, in encrypted form.

End-to-End Encrypted Cloud Sync: Data is locked with a cryptographic key that only you possess. We do not possess the keys required to decrypt such data. If you lose your Recovery Key, your cloud data may be permanently unrecoverable.
Data Export: If you choose to use the Service’s export functionality, exported data is not encrypted by Noereli. Once exported, this data is stored according to your device’s file system and settings. You acknowledge that anyone with access to your device or exported files may be able to read this data, and you assume all responsibility for securing exported files.
Data Loss: To the maximum extent permitted by applicable law, you waive any right to claim damages against Gammahammer LLC for data loss resulting from forgotten credentials, device failure, app uninstallation or other circumstances outside our control.

Application Data: The Service maintains account-related data necessary for functionality, referred to as "AppUser", which may include limited usage metrics, referred to as "AppUsage", such as feature interactions and interface preferences. This data does not include journal content and may be stored in a non-encrypted format. You acknowledge that such data is used to operate and improve the Service.

Suspension and Termination: We reserve the right to suspend or terminate your access to the Service at any time. Upon termination, we may suspend your account or access to the Service, including access to cloud sync functionality. You are responsible for exporting your data before such events where possible. Certain account-related data may be retained or deleted in accordance with our Privacy Policy.


4. Intellectual Property and Content Moderation
Ownership: We retain all rights to the Service. You retain ownership of your journal entries.

Content Moderation: Gammahammer LLC does not actively monitor or moderate content stored in encrypted form due to our end-to-end encryption architecture. However, we reserve the right to suspend accounts or restrict access to the Service if we receive reports or notice of activity that is unlawful, harmful or in violation of these Terms, including through AI processing logs or user reports.


5. Subscriptions and Mandatory Consumer Rights
Premium Access and Trials: Noereli is a premium service. Access to the core features of the Service requires an active subscription, a valid free trial or a one-time "Lifetime" purchase.

Billing: All payments, subscriptions and free trials are managed and processed by Apple or Google depending on your device.

Consumer Guarantees: Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy provided by applicable consumer law, including the Australian Consumer Law and the New Zealand Fair Trading Act, that cannot be excluded. Subject to these mandatory rights, all purchases are final and non-refundable by Gammahammer LLC.

Lifetime Definition: "Lifetime" refers to the lifespan of the Noereli application, not the lifetime of the user.


6. Acceptable Use
We reserve the right to restrict access to the Service or suspend your account if you engage in prohibited conduct, including reverse-engineering the app, abusing AI APIs through prompt injection, attempting to disrupt the Service or storing material related to the exploitation of minors.


7. Disclaimer of Warranties
SUBJECT TO MANDATORY CONSUMER PROTECTIONS, THE SERVICE IS PROVIDED "AS IS." WE EXPRESSLY DISCLAIM ALL WARRANTIES TO THE EXTENT PERMITTED BY LAW.
We do not guarantee that the Service will be uninterrupted, secure or error-free. AI-generated analysis may occasionally be inaccurate, biased or incomplete due to the nature of generative AI and the underlying datasets.


8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY APPLICABLE LAW, GAMMAHAMMER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR PUNITIVE DAMAGES.
Our total cumulative liability shall not exceed the greater of $100.00 USD or the amount you paid us in the last 12 months.


9. Dispute Resolution and Jurisdiction
Governing Law: These Terms are governed by the laws of the State of Delaware, USA.

Binding Arbitration: Any dispute, claim or controversy arising out of or relating to the Service or these Terms shall be resolved exclusively by binding arbitration through the American Arbitration Association in Delaware.

Mandatory Rights: Nothing in this section limits any rights you may have under mandatory consumer protection laws in your jurisdiction. Where the arbitration clause or choice of Delaware law is found to be unenforceable by a court of competent jurisdiction, you agree that the dispute will be resolved in the competent courts of your place of residence.


10. Third-Party Services
The Service and related website rely on third-party providers for infrastructure, authentication, analytics, email communications, payments and support functionality. These providers may include Firebase, RevenueCat, Apple, Google, Umami, MailerLite and other service providers necessary to operate the Service and website. By using the Service or interacting with our website, you acknowledge that certain data may be processed by these providers in accordance with their own terms and policies.


11. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Gammahammer LLC. In the event of a conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy shall control.


12. Apple App Store Supplemental Terms
If you download the Service from the Apple App Store, the following additional terms apply:

Acknowledgment: You and Gammahammer LLC acknowledge that these Terms are concluded between you and Gammahammer LLC only, and not with Apple. Gammahammer LLC, not Apple, is solely responsible for the Service and the content thereof.

Scope of License: The license granted to you for the Service is a non-transferable license to use the Service on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Service may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

Maintenance and Support: Gammahammer LLC is solely responsible for providing any maintenance and support services with respect to the Service, as specified in these Terms or as required under applicable law. You and Gammahammer LLC acknowledge that Apple has no obligation to furnish any maintenance and support services with respect to the Service.

Warranty: Gammahammer LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Service, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Gammahammer LLC.

Product Claims: You and Gammahammer LLC acknowledge that Gammahammer LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including product liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement and claims arising under consumer protection, privacy or similar legislation.

Intellectual Property Rights: You and Gammahammer LLC acknowledge that, in the event of any third-party claim that the Service or your possession and use of the Service infringes that third party’s intellectual property rights, Gammahammer LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Legal Compliance: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the Service.

Third-Party Beneficiary: You and Gammahammer LLC acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
